JAKARTA, AKSIKATA.COM – Baru juga keluar penjara melalui program asimilasi, Habib Bahar bin Smith kembali diseret masuk bui. Ini lantaran, Ditjen Pemasyarakatan (Pas) Kemenkum HAM menilai Bahar melanggar syarat asimilasi sehingga ia harus melanjutkan proses pemidanaan di penjara karena kasus penganiayaan.
Lalu apa yang dilanggar Bahar? Dirjen Pemasyarakatan Reynhard Silitonga dalam siaran pers, Selasa (19/5/2020), menjelaskan bahwa kesalahan Bahar bin Smith adalah, tidak mengindahkan dan mengikuti bimbingan yang dilakukan oleh PK Bapas Bogor, yang memiliki kewenangan melakukan pembimbingan dan pengawasan pelaksanaan asimilasi di rumah. Selain itu, Bahar dinilai telah melakukan pelanggaran khusus saat menjalani masa asimilasi.
Tak hanya itu saja, menurut Reynhard, Bahar melakukan beberapa tindakan yang dianggap telah menimbulkan keresahan di masyarakat, yaitu menghadiri kegiatan dan memberikan ceramah yang provokatif dan menyebarkan rasa permusuhan dan kebencian kepada pemerintah. Ceramahnya telah beredar berupa video yang menjadi viral, yang dapat menimbulkan keresahan di masyarakat.
Selain itu, Bahar juga dinyatakan melanggar aturan pembatasan sosial berskala besar (PSBB) dalam kondisi darurat COVID di Indonesia, dengan mengumpulkan massa (orang banyak) dalam pelaksanaan ceramahnya.
Atas perbuatan tersebut, Bahar dinyatakan telah melanggar syarat khusus asimilasi, sebagaimana diatur dalam Pasal 136 ayat 2 huruf e Permenkumham Nomor 3 Tahun 2018. “Kepadanya dicabut asimilasinya dan selanjutnya diperintahkan untuk dimasukkan kembali ke dalam Lembaga pemasyarakatan untuk menjalani sisa pidananya dan sanksi lainnya sesuai ketentuan,” kata Reynhard.
Pencabutan SK asimilasi dilakukan oleh Kepala Lapas Cibinong, yang pada 15 Mei 2020 telah mengeluarkan SK Asimilasi Nomor W11.PAS.PAS11.PK.01.04-1473 Tahun 2020. Pencabutan SK Asimilasi dilakukan berdasarkan hasil penilaian PK Bapas Bogor yang melakukan pembimbingan dan pengawasan terhadap Bahar.
